Data Policy

This page is for a business that has found a page about itself on this site that it did not ask for. It sets out where the information came from, how to correct it, and how to have it removed.

Nothing on this page costs money, requires an account, or requires a subscription.

1. Why a profile exists without a request

In Florida a pool contractor’s record is substantially public. Licences are on file with the Department of Business and Professional Regulation. Reviews are published on platforms open to anyone. Company descriptions and photographs of completed work are published by the companies themselves on their own websites.

We assemble that material into a single page for each licensed pool contractor for which we can find a trading record, so that a homeowner can compare businesses on the same basis. That is an information service, and it is the basis on which any directory, trade publication or newspaper publishes about a business. It does not require the business’s consent.

Publishing without consent carries one obligation, and this page is it: the record must be correctable, and leaving must be easy.

2. Where each part of a profile comes from

Every profile states the date it was last refreshed. Anything on it may have changed since. The registers linked from the profile are the authority.

We do not use building-permit records. They are not on a profile and are not used in the Score.

3. What we do not publish

  • Any conclusion by us as to whether a business’s own advertising is true. Where a business describes itself in promotional terms, that is presented as the business’s own statement.
  • Anything a homeowner told us in confidence. A quote request is never published, and a business’s private notes on a request are never shown to the homeowner.
  • A personal telephone number, personal email address, personal photograph or personal social profile on an unclaimed profile.
  • A star rating of our own presented as a platform’s. Platform ratings are labelled with the platform and the count.
  • Any figure for which we cannot identify a source.

4. What we publish that businesses sometimes object to

Complaint themes and critical reviews remain on the page. Where reviewers repeatedly raise the same issue, the profile records it alongside what reviewers praise, stating the number of reviewers to which it relates. A profile presenting only favourable material is advertising rather than information.

These summaries describe patterns in reviews published by third parties. They are identified as summaries, they state their denominator, and they are offered as opinion and fair comment. They are not statements of fact about any business. An individual allegation is reported as an allegation, attributed to its source; we do not adjudicate it and we do not endorse it.

The Score is not favourable to every business. It weights recent evidenced activity heavily and weighs what a business can show against what it claims. We will explain any individual Score to the business concerned on request.

No payment alters either. No subscription suppresses a complaint theme, removes a critical review, or raises a Score. Terms §9.3.

5. Correcting information

The form at /data-accuracy/ is the fastest route. It reaches a person.

We undertake that:

5.1 Every report is read by a person, and verified inaccuracies are corrected promptly and without charge.

5.2 A report from the business the record concerns takes priority over other reports.

5.3 Correction is not conditioned on payment, on holding an account, or on the existence or level of a subscription, and no subscription confers priority in handling a correction.

5.4 Where a figure originates from a source we do not control — a licence register, a review platform — we will correct how it is presented, identify where the underlying record must be changed, and where practicable cease relying on the disputed figure in the interim.

5.5 Where we decline to make a change, we will say so and say why.

Once a profile is claimed, the description, services, areas, hours, contact details and photographs are editable directly, and what a business supplies is protected against our subsequent imports — we do not overwrite a business’s own statement about itself with something we measured later.

Measured fields — licence data, ratings, review counts, activity indicators, evidenced coverage and the Score — are not editable, and are addressed through §5.1 to §5.5.

6. Removal

A business may require its profile to be removed, and we will remove it.

6.1 Email hello@floridapoolz.com from an address at the business’s domain, or provide another means by which we can confirm that you act for the business.

6.2 No reason is required, no charge applies, and we will not make removal conditional on anything. We will not attempt to sell you a subscription in response to a removal request.

6.3 We action removal promptly.

6.4 What removal does. The profile ceases to be published, ceases to appear in the directory and on location pages, and is withdrawn from our sitemap. We request that search engines remove it from their indexes. We do not control how quickly a third-party index updates.

6.5 What we retain. A minimal record that the business exists and has asked to be removed, so that it is not republished at a subsequent import, together with anything we are required to retain by law or need in order to establish or defend a legal claim. That record is not published.

6.6 Suppression instead. On request we will instead withhold the profile from search indexes while retaining it, so that the business keeps the option of claiming it later.

6.7 Verification. We verify that a removal request comes from the business before acting on it. A request from an address that does not correspond to the business is checked by a person first.

7. Photographs and copyright

Photographs on an unclaimed profile came from that business’s own publicly accessible website.

Two things are true of every photograph published on this site:

  1. A person reviewed it before publication. We hold a record of who reviewed each photograph and when.
  2. The profile identifies where the photographs came from, in the sources table, with the date last checked.

7.1 Removal on request. A business may require any photograph or its logo to be removed. Email us and identify it, or claim the profile and remove it in the profile manager, where removals are permanent and survive subsequent imports. No explanation is required and no charge applies.

7.2 Rights holders other than the business. A photographer or other rights holder may require removal on the same basis, and may in addition proceed under §7.3.

7.3 Formal notice. A notice under the Digital Millennium Copyright Act may be sent to us at hello@floridapoolz.com, containing: identification of the work; identification of the material and its location on the site; your name, address, telephone number and email address; a statement of good-faith belief that the use is unauthorised; a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for the owner; and your signature. We will remove or disable access to the material promptly. We terminate the accounts of repeat infringers. A person submitting a materially false notice may be liable under 17 U.S.C. §512(f).

7.4 The statutory safe harbours protect a service provider against infringement by its users. For material a business uploaded, §7.3 is the applicable route. For material we sourced ourselves we are the publisher, and no safe harbour applies. What we undertake instead is §7.1: removal on request, immediately, without argument. In practice §7.1 is faster than §7.3.

8. Names of individuals

Where a licence is held by a named qualifying individual, that name forms part of the public licence record and may appear on the profile as a verification fact.

Any individual named on a page may require their name to be removed. We will remove it and retain the licence fact without it. No reason is required.

We do not use any individual’s name to promote a subscription, and no page requires a reader to register in order to see who operates a business.

9. Reviews

We do not host reviews and do not solicit them. We report what public platforms report, labelled by platform and dated, and we summarise the themes.

A review that is false or defamatory can only be removed by the platform hosting it. Report it there. Report it to us as well: if it is removed at source our figures update at the next refresh, and on notice that a review is fraudulent we will consider whether to continue relying on figures derived from it.

10. Ranking, and what payment affects

Within any list of businesses on this site, businesses are ordered by their FloridaPoolz Score. That order is not available for purchase, and no payment alters a business’s position within a list.

Payment affects placement. Claimed and paid listings are presented together in a labelled section above the main list. Which section a listing appears in is our editorial decision as publisher. Within that section the order remains the Score’s, and a business on an unpaid claimed tier may appear above a paying subscriber.

Payment affects the order in which requests are offered. Where a homeowner’s request is offered onward, businesses holding a subscription are offered it before businesses that do not, and a subscription permits a business to register for more towns. Otherwise the next business is determined by whose turn it is — not by distance, and not by any assessment of quality. /lead-rules/ sets this out.

Payment does not and will not affect the Score or any factor in it, ratings, review counts, review text, or summaries of review themes; it does not procure the removal of unfavourable material; it does not cause a request to be offered to a business that does not do the work or does not cover the area; and it affects nothing in this document. Correction and removal are free, equal in priority, and identical for a paying subscriber and for a business that has never contacted us.
